Terms of Use

Last updated: 2026-09-24

1. Agreement and operator

These Terms govern your use of Photo Keepside (the “App”) and related services provided by the operator of Photo Keepside (“we,” “us,” “our”). Contact: support@photokeepside.com. Please read them before using the App. If you do not agree, do not use the App. Any acceptance process required by applicable law must be completed before these Terms bind you.

You must have legal capacity to agree or use the App with the authorization of a parent or legal guardian where permitted. The App is not directed to children under 13; additional local age requirements apply.

2. What the App does

The App lets you view photos and videos and import, view and manage selected media and files in a private vault. Available features depend on your release, device, permissions and any applicable purchased entitlement.

The scope of these Terms is version 1.0. Its functionality is described by the features actually available in that release and the corresponding App Store listing.

3. Imported content and backups

Importing a file into the vault makes a copy and does not itself remove the original from Apple Photos or its source provider. Deleting a vault file is separate from deleting the original. Review your selection before removing a vault item; the vault does not promise a recycle bin or recovery service.

Keep independent copies of important files. Changes you make separately in Apple Photos, iCloud or another storage service are subject to that provider’s rules and synchronization settings and may affect other connected devices. The App does not prevent those external changes or guarantee recovery of deleted files.

4. Vault limitations

You are responsible for protecting your device, device passcode and vault PIN. Face ID depends on compatible hardware and iOS settings. The App uses system access and file-protection mechanisms; the vault is not a promise of absolute security or a backup service.

Loss of the device, deletion of App data, uninstalling the App or other failures can cause loss of locally stored files. Verify that important files have another accessible copy before removing the App or its data. These precautions do not remove any statutory responsibility we have for defects or loss caused by us.

5. Purchases and subscriptions

If paid features are offered, available plans, prices, currency, billing intervals, trial conditions and included features are displayed before purchase. Only the offer presented and confirmed through Apple applies; these Terms do not promise that any particular plan or trial is available.

Apple processes App Store payments. Auto-renewing subscriptions continue for successive billing periods unless canceled under the applicable Apple purchase conditions. Any trial that converts to a paid subscription will state its duration and subsequent price before enrollment. Cancel before the displayed renewal or trial deadline; for a free or discounted trial, Apple advises cancellation at least 24 hours before it ends.

Manage or cancel in iPhone Settings > your name > Subscriptions. Uninstalling the App, removing files, or contacting our support does not itself cancel an Apple subscription. Cancellation generally stops future renewal, with remaining access governed by the offer and Apple’s rules. Restore eligible purchases using the App’s restore function with the Apple Account used to purchase.

If a one-time “Lifetime” option is offered, it means a non-recurring entitlement to the purchased feature set for the supported lifetime of this App, subject to applicable law. It does not promise perpetual operation, every future product or feature, or online storage. The purchase offer specifies the features included.

Refunds for Apple-billed purchases are handled through Apple at https://reportaproblem.apple.com/, subject to applicable law. We do not exclude any statutory refund or withdrawal rights. Price changes and consent requirements follow applicable law and Apple’s applicable procedures.

6. License and Apple terms

For copies obtained from the App Store, Apple’s Standard Licensed Application End User License Agreement applies to the software license unless a valid custom EULA is expressly supplied in the store listing: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ . These Terms supplement that license for the service and do not replace it. If a conflict concerns the software license, the applicable EULA controls; mandatory consumer law always prevails.

Apple’s applicable usage rules also apply. We provide App-related support at the contact email in section 12. Apple’s role and any obligations concerning the licensed software remain as stated in the applicable EULA and law.

7. Your content and acceptable use

You retain your rights to your photos, videos and files. You authorize only the processing necessary for the features you request; importing media does not give us a right to publish or commercially exploit it.

Use the App only for content you are entitled to access and in compliance with law. Do not use it to infringe others’ rights, distribute unlawful material, interfere with the service, bypass access controls or payment requirements, or misuse purchase entitlements. Restrictions do not prohibit activities that applicable law expressly permits despite contractual limitations.

Our App design, code and branding belong to us or our licensors. No ownership in them transfers to you.

8. Privacy and third-party services

Our Privacy Policy explains how Photo Keepside handles personal data. You may request a copy at the contact email in section 12. Acceptance of these Terms is not consent to optional tracking or processing that requires separate consent.

Apple, file-storage providers and other third-party services operate under their own terms. Their availability and system restrictions can affect the App. We remain responsible for our obligations and for service providers to the extent required by law.

9. Changes, suspension and termination

We may provide updates or modify features for technical, security or legal reasons. Material changes affecting paid access will be handled with any legally required notice, consent or remedy. We will not use these Terms to remove mandatory consumer protections.

We may restrict service for a material breach, unlawful use or a serious security risk, proportionately and with notice and an opportunity to remedy where appropriate. You may stop using the App at any time. Stopping use does not cancel a subscription; follow section 5. Before removal, preserve important local files. Provisions that by their nature should survive termination remain effective.

10. Warranties and responsibility

We will provide the service with the care required by applicable law. Except for express commitments and mandatory warranties, we do not promise uninterrupted or error-free operation, recoverability of deleted data or suitability for every purpose.

To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when these Terms were agreed. This does not exclude liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or other liability that cannot lawfully be excluded. It does not create a waiver of remedies for a defective digital service. Any statutory rights more favorable to you prevail.

11. Governing law and disputes

The law applicable to these Terms is determined under applicable conflict-of-laws rules. Nothing in these Terms deprives consumers of mandatory protections of their usual place of residence. Contact the contact email in section 12 first if you wish to seek an informal resolution. This does not prevent you from contacting a regulator, seeking urgent relief or exercising statutory remedies.

Disputes may be brought before courts competent under applicable law, including any consumer forum you are legally entitled to use. These Terms do not impose mandatory arbitration or a class-action waiver.

12. General provisions and updates

If a provision is unenforceable, the remainder continues to apply to the extent lawful. Failure to enforce a right is not a waiver. Changes to these Terms will be dated and communicated as required by law. Where affirmative acceptance is required, we will obtain it before the change binds you; changes do not retroactively remove accrued rights.

English and Chinese versions are intended to express the same terms. Any inconsistency will be resolved consistently with applicable law and mandatory language protections, rather than removing rights through a translation difference.
